1. Contract Formation

By accessing or using the website located at https://iuzmit-gt.myshopify.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Site. These Terms constitute a legally binding agreement between you and Rebecca Nicole Tippner, the individual operator of Fonthorini.

2. Governing Law and Venue

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Tennessee. Any disputes arising out of or relating to these Terms shall be resolved exclusively in the courts located in Tennessee.

3. Binding Individual Arbitration Clause

Any dispute or claim relating in any way to your use of the Site will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration shall be conducted under the American Arbitration Association's Consumer Arbitration Rules. The arbitration location shall be in Johnson City, Tennessee, and shall be conducted by a single arbitrator. You have the right to opt-out of this arbitration clause by sending a written notice to costumer@fonthorini.com within 30 days of your first use of the Site.

4. Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other; there is no right or authority for any dispute to be arbitrated on a class-action basis or to utilize class action procedures.

5. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Rebecca Nicole Tippner be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Site; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein. Our liability shall be limited to the amount you paid for the products in the 12 months preceding the claim.

6. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, and software, is the property of Rebecca Nicole Tippner and is protected by United States and international copyright laws. You may not use, reproduce, distribute, or create derivative works from any content on the Site without express written permission.

7. User Obligations

By using the Site, you agree not to engage in any fraudulent activities, use any automated means to access the Site, or resell any products purchased from the Site without express permission. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

8. Disclaimer of Warranties

The Site and all products and services provided through it are provided "AS IS" and "AS AVAILABLE," without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. This disclaimer does not affect any warranties that cannot be excluded or limited under applicable law, including the Magnuson-Moss Warranty Act.

9. Dispute Resolution

Before initiating arbitration, you agree to attempt to resolve any dispute informally by contacting us at costumer@fonthorini.com. We will attempt to resolve the dispute informally within 30 days. If the dispute is not resolved within 30 days, either party may begin arbitration proceedings.

10. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

11. Modifications of the Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on this page, and the "Last Updated" date will be revised. Your continued use of the Site following the posting of changes constitutes your acceptance of such changes.

12. Termination

We reserve the right to terminate your account and restrict your use of all or any part of the Site at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Site, us, or third parties, or for any other reason.

Notwithstanding the arbitration clause, nothing in these Terms shall waive any consumer's right to seek public injunctive relief under California law (per McGill v. Citibank, 2 Cal. 5th 945 (2017)).
